We, at Cunnekt, (Cunnekt, We, us, our) respect the privacy of our users (Users, you, your, client) and we want you to be informed of our practices, when we collect, process, use and disclose information. This Privacy Policy (Policy) governs our data collection, processing, and transfer protocols, to enable you to better understand the manner in which we handle your personal information (as defined by law). This Privacy Policy covers only information collected through our website, and mobile application (Platform) and does not cover any other data collection or processing, without limitation, collection conducted offline, or through our products or services that do not link directly with this Policy, or by third-party sites that we may link to.
By accessing, downloading, and/or using the Platform, you agree to be governed by the terms of this Policy. This Policy shall be read in conjunction with the Terms of Use, which shall form a binding agreement with you.
The Information We Collect
1. Information you provide to us :
Cunnekt, may collect and process the following data about you, which you may submit to us, from time to time:
- information that you provide to us when you register your account with Cunnekt – a. Full Name b. Email Address c. Personal Whatsapp Number d. Organization Name
- the information shared during correspondence between you and Cunnekt for feedback purposes.
- information collected from you when you subscribe to a paid subscription, you shall provide us or your billing details limiting to your Business Name, Address & GST Number. You will also be bound by the terms of use, and privacy policies of the payment providers when purchasing a plan, and we urge you to review and familiarize yourself with the policies of these websites, prior to continuous interaction with them.
In all the scenarios indicated hereinabove, you will be actively submitting the information to us, and we will process this information basis your explicit consent.
2. Information we collect automatically.
- Activity Data: Our servers automatically record information during your use of the Services. This data may include information such as your time stamps, device and application IDs, Platform interaction data, IP, Device ID, Application ID, Device Build, Device OS, and cookie information.
- Cunnekt uses cookies and other similar technologies on the Platform. These technologies operate either by placing a small file that stores some information on your computer or mobile device; and/or by accessing the information on your device. Cunnekt uses cookies and similar technologies to recognize you and your device, to enable us to provide you with more customized services; and to collect data such as your device’s model, operating system and screen size, and information about how you use the Services. You can disable cookies on your web or mobile device through browser settings.
3. Third-party services:
Cunnekt uses a variety of third-party services to help its provision of the Services, such as hosting and other services. These third-party service providers may collect information sent by your browser as part of a web page request, such as cookies or your IP address, location, and devices’ unique identifiers. These data are non personalized and are used only for analytics purposes.
4. Use of Information
You agree that Cunnekt and/or third parties acting on its behalf and/or its partners may use the Information for the purposes of:
- to create your account with us;
- to determine your eligibility to avail of the Services;
- provide requested information and support, to effect financial transactions and correspondence;
- to facilitate platform interactions;
- for the performance of a legal or contractual obligation;
- improve the Services, design, and navigation of the Platform;
- to send you commercial, and marketing communications about the Services;
- research, surveying, by a combination of your information, to the extent permissible in law;
- for grievance redressal;
- To comply with our obligations under applicable law, and for any future compliance with the orders, and directions of a regulatory body or a law enforcement agency (LEA).
5. Information sharing and disclosure
- Cunnekt will only share your data with third parties in accordance with this Policy in order to provide the Services and enable improved user experiences. We engage third parties for the purposes of providing us with infrastructural, transactional, maintenance and support, analytics provider (Google Analytics), marketing, and allied services, and accordingly, we share only such information with them which is necessary for us to provide our Services to you.
- We will not disclose your personal information to third parties, except (a) with your consent; (b) to our subsidiaries and service providers to fulfill a contractual obligation to you; (c) to service providers who act on our behalf and under our instructions to perform certainly; (d) as required by applicable law, such as to co-operate with law enforcement agencies or upon receipt of a court order; (e) to courts and public authorities to protect you, us, or third parties from harm, including fraud or instances where somebody’s physical safety is at risk; or (f) if we (or our affiliates) are involved in a merger, acquisition, and sale of all or substantially all of its assets or equity.
- We may also share aggregated non-personally identifiable information publicly and with our partners, like publishers, advertisers, or connected sites.
6. Data Retention
- Cunnekt retains different categories of data for different periods depending on the nature and purpose of collection:
- Account data (name, email, organisation details): retained for the duration of your active subscription and for 30 days post-termination, after which it is deleted unless retention is required by law.
- Billing and financial data (invoices, GST records, payment history): retained for a minimum of 8 years as required under applicable Indian tax and accounting laws.
- Usage and activity logs (platform interactions, IP addresses, device data): retained for up to 12 months from the date of collection.
- Support and correspondence data: retained for 2 years from the date of last interaction.
- Marketing consent records: retained for the duration of your subscription and 3 years thereafter for compliance purposes.
- Where retention is required by applicable law, a court order, or ongoing legal proceedings, data may be retained beyond the periods stated above. Once the retention period expires, data is securely deleted or anonymised.
7. Data Principal Rights
In accordance with the Digital Personal Data Protection Act, 2023 (DPDP Act) and applicable rules, you have the following rights in relation to your personal data:
- Right to Information: You have the right to obtain a summary of the personal data we hold about you and the purposes for which it is being processed.
- Right to Correction and Erasure: You may request correction of inaccurate or incomplete personal data, or erasure of personal data that is no longer necessary for the purpose for which it was collected, subject to our legal retention obligations.
- Right to Withdraw Consent: Where processing is based on your consent, you may withdraw that consent at any time by writing to us at info@cunnekt.com or through the account settings on the platform. Withdrawal of consent will not affect the lawfulness of processing carried out prior to withdrawal. Please note that withdrawal of consent for certain categories of data may affect your ability to use the platform or specific features thereof.
- Right to Grievance Redressal: You have the right to have your grievances addressed by our Grievance Officer within the timelines specified in the Grievance Redressal section of this Policy.
- Right to Nominate: In the event of your death or incapacity, you may nominate another individual to exercise your data rights on your behalf. To register a nomination, please contact us at info@cunnekt.com.
- Right to Opt Out of Marketing: You may opt out of receiving marketing and promotional communications from us at any time by clicking the unsubscribe link in any marketing email, replying STOP to any WhatsApp marketing message, or writing to us at info@cunnekt.com. We will process your opt-out request within 7 business days.
To exercise any of the above rights, please contact our Grievance Officer at the details provided below. We will acknowledge your request within 48 hours and aim to resolve it within 30 days of receipt, in accordance with the DPDP Act 2023.
8. Data Security and Data Protection
- Cunnekt maintains appropriate technical and physical safeguards to protect your information against accidental or unlawful destruction, loss, alteration, unauthorised disclosure or access, and any other unlawful forms of processing. These measures include encryption of data in transit, access controls, and regular security reviews.
- Cunnekt does not warrant that the platform, its servers, or any communications shared by or on behalf of Cunnekt are completely impenetrable from a security standpoint or are virus-free. Cunnekt will not be liable for any damages arising from the use of the platform to the extent permitted by applicable law.
- Data Breach Notification: In the event of a personal data breach that is likely to result in harm to you, Cunnekt will notify the Data Protection Board of India as required under the DPDP Act 2023. Where required by law or where we assess that notification is necessary to allow you to take protective measures, we will also notify affected users without undue delay. Notification will be made to the email address registered with your Cunnekt account.
9. Cross-Border Transfers.
Your information may be transferred to and stored in locations outside the laws of the territory in which our affiliates, and subsidiaries are incorporated, and worked out. We will do this only when the destination jurisdiction has an adequate and appropriate level of protection and where the transfer is lawful and necessary for the performance of our obligations to you. When we transfer your personal information from your home country to the alternate country, we will comply with our legal and regulatory obligations in relation to your personal information including having a lawful basis for transferring personal information and putting appropriate safeguards in place to ensure an adequate level of protection for the personal information. Our lawful basis for such transfer will be either on the basis of consent or one of the safeguards permissible by laws.
10. Cookies and Tracking Technologies
Cunnekt uses cookies and other tracking technologies on the platform and website. The following types of technologies are in use:
- Essential Cookies: Required for the platform to function. These cannot be disabled as they enable core features such as login sessions, security, and account management.
- Analytics Cookies (Google Analytics): We use Google Analytics to understand how users interact with our platform. Google Analytics collects data such as pages visited, time spent, device type, and general location. This data is aggregated and non-personally identifiable. You can opt out of Google Analytics tracking at all times by installing the Google Analytics Opt-out Browser Add-on.
- Marketing and Retargeting Pixels (Meta/Facebook Pixel): Our website uses the Meta Pixel, a tracking code provided by Meta Platforms Inc. The Meta Pixel collects data about your activity on our website and sends it to Meta to enable us to measure the effectiveness of our advertising, build advertising audiences, and run targeted ads. Data collected by the Meta Pixel may include your IP address, browser information, pages visited, and actions taken on our website. This data is processed by Meta in accordance with Meta’s Data Policy. You can manage your ad preferences and opt out of interest-based advertising via your Facebook Ad Preferences or through the Digital Advertising Alliance opt-out tool.
- Managing Cookies: You can control and disable cookies (other than essential cookies) through your browser settings. Please note that disabling certain cookies may affect the functionality of the platform. For detailed guidance on managing cookies, refer to your browser’s help documentation.
11. Lawful Basis for Processing
Cunnekt processes your personal data on the following lawful bases under the Digital Personal Data Protection Act, 2023 and applicable law:
- Consent: For account registration, marketing communications, and cookie-based tracking (other than essential cookies). You may withdraw consent at any time as described in the Data Principal Rights section above.
- Contractual Necessity: For processing necessary to provide you with the platform and services you have subscribed to, including billing, account management, and customer support.
- Legal Obligation: For processing required to comply with applicable laws, including tax and accounting requirements, court orders, and directions from regulatory or law enforcement authorities.
- Legitimate Interests: For analytics, platform improvement, fraud prevention, and security — where our legitimate business interests are not overridden by your rights and interests.
12. WhatsApp Message Data and End-Customer Data
- As a WhatsApp Business API Technical Service Provider (TSP), Cunnekt facilitates the sending and receiving of WhatsApp messages on behalf of its business clients (Users). In this capacity, Cunnekt may process certain message-related data including message delivery metadata, template usage records, and platform activity logs.
- Cunnekt does not read, store, or use the content of WhatsApp messages sent by Users to their end-customers for any purpose other than platform operation, delivery confirmation, and compliance with applicable law.
- Business Users (clients) are independent data fiduciaries in relation to the personal data of their own end-customers. Cunnekt acts as a data processor on behalf of such Users only to the extent necessary to deliver the platform services. Users are solely responsible for ensuring that their collection and use of end-customer data through the Cunnekt platform is compliant with applicable data protection laws, including obtaining all necessary consents from their end-customers.
- Cunnekt does not sell, share, or use end-customer data (i.e., the personal data of Users’ customers) for its own marketing, analytics, or commercial purposes.
13. Changes to our Privacy Policy.
Cunnekt may periodically review from time to time and change this Policy to incorporate such future changes as may be considered appropriate and shall strive to update you of such changes with prior notice, where possible. We urge you to review the policy on a periodic basis; in the event, we make any significant changes to this Policy we shall communicate the same to you in advance. Your continued use of the Platform and our Services shall be considered to be your consent to the prevailing Policy.
